The State had earlier stated that the Makadara Member of Parliament had been cleared of all charges connected to participating in an unlawful protest and organizing an unlawful assembly. On Tuesday, September 26, the High Court in Nairobi released Peter Imatwok and Moses Ogeto, two members of the Orange Democratic Movement’s County Assembly who were charged alongside Aladwa.
As a result, the Judge mandated that the State refund the monetary bail that the lawmakers from the ODM Party had posted to secure their release.Bryan Khahemba, the attorney for Aladwa, pointed out that the accusations made against his client were false from the start.
According to a letter Khaemba addressed to the Makadara Member of Parliament, “the file was marked as closed and cash bail to be refunded.”The ODM politicians were ordered to turn themselves up to the closest police station on July 22 in order to face charges of participating in an unlawful protest and organizing an unlawful assembly, according to a news release from the Office Inspector General of Police.
ODM Party Nairobi Chairman George Aladwa, MCAs Peter Imwatok and Moses Ogeto, and other party members hurried to court on July 24 to obtain anticipatory bail in order to prevent their arrest and imprisonment in response to the Office Inspector General of Police’s announcement.In order to prevent the three from being arrested while the case is being heard and decided, Justice Diana Kavedza issued orders to the Inspector General of Police and Directorate of Criminal Investigations.
However, Justice Kavedza permitted the ODM Party officials to be cited for any illegal activity by both IG Japhet Koome and DCI Amin Mohammed.”That the respondents are free to look into or accuse the applicant of any criminal conduct, for the avoidance of doubt.
