Kenyans, who are already severely impacted by growing living expenses and higher taxes, may be particularly negatively impacted by the Ministry of Lands’ new planned reforms that will raise land transaction fees. The statute has been amended by Lands Cabinet Secretary Alice Wahome, who has suggested raising certain land charges that haven’t been changed in decades.
“Amending the current state instruments that have not been updated in a long time is the primary goal of the proposed statutory instruments, particularly with regard to fees and charges prescribed for various services rendered by the Government in the land sector,” the CS said. The cost of an official land search has been increased to Ksh 2,000. Document registration will cost Ksh 1,500, in addition to corporate certificate expenses.
Additionally, the ministry increased the incorporation charge from Ksh 5,000 to Ksh 50,000. According to her ideas, the first ten pages of the application for certified copies of the proceedings arising from the land registrar’s decision will now cost Ksh 3000. Ksh 100 will be deducted from applicants for each extra page.
Any document that needs to be registered again will cost Ksh 1,500, and any name corrections that need to be made but haven’t been completed by the registrar will cost Ksh 2,500. The fee to revoke the attorney’s power of attorney is Ksh 5,000. Setting boundaries will now cost Ksh 5,000, while confirming boundary disputes will now cost Ksh 5,000. The cost to place a caution is Ksh 3,000.
When providing registration counsel, any land registry that spends a day away from the office would charge Kenyans Ksh 5,000 in addition to transportation expenses. The government claims that the changes were made since there haven’t been any significant upgrades in more than 30 years.
The ideas follow the government’s recent push to raise taxes and fees for important services. The Ministry of Interior recently published a list of updated fees for a number of government services, such as getting a passport, replacing a driver’s license, and applying for citizenship.
