Brian Mwenda granted Ksh200 000 bail
Alleged imposter Brian Mwenda, who is charged with pretending to be another lawyer, was given a Ksh200,000 cash bond on Monday. Mwenda had previously submitted an affidavit to a Nairobi court asking for his release on bail or bond.
Mwenda refuted the claims that he eluded being detained by the Directorate of Criminal Investigations (DCI) investigators and that he is a flight risk in the lawsuit that his attorney, Danstan Omari, filed on his behalf. He also denied all charges brought against him as being unfounded.
“Statements that I am a flight risk are merely speculative and now that I understand that I am under investigations, there is no reason for me to get out of the court’s jurisdiction nor abscond attending court but this can be taken care of by the court imposing an order for me not to leave the courts jurisdiction during the pendency of this suit unless otherwise permitted by this court,” Mwenda wrote in his affidavit.
Mwenda criticized the Law Society of Kenya (LSK) for being heavily involved in the case and claimed that the National Police Service (NPS) and the Office of the Director of Public Prosecutions (ODPP) alone had the authority to investigate and prosecute crimes. Mwenda’s admission that Law Society of Kenya (LSK) President Eric Theuri, who has been outspoken in calling Mwenda a quack, used his influence to bail out Mwenda and his friends from various police stations whenever they were detained for drinking, stands out as a noteworthy development in the case.
Due to his strong friendship with Theuri and Vice President Faith Odhiambo, Mwenda wants them both to be prohibited from speaking on behalf of the Society.”In the unlikely event that I am put on defence, I may be calling both of them in this case as my defense witnesses,” Mwenda stated.
Theuri and Odhiambo, whom Mwenda claimed to have known for two years, allegedly became involved in the case to stop him from disclosing private information about them.The purportedly false attorney additionally asserted that he was instrumental in Theuri’s campaigning for the LSK leadership in 2022.
On October 17, Mwenda was apprehended after showing up at the DCI offices. He was identified by LSK for practicing without a license and impersonating another advocate, which led to his imprisonment. It was widely believed at the time that he had successfully argued 26 cases, however LSK has now refuted that assertion.
