On Wednesday, January 24, the United Democratic Alliance (UDA) nominated nine Members of the County Assembly (MCA) from Uasin Gishu, but the Court of Appeal revoked their nominations. Furthermore, the Independent Electoral and Boundaries Commission (IEBC) was mandated by the Court of Appeal to degazette their names in a matter of 14 days.

The MCAs filed an appeal with the High Court, which denied it, and confirmed the decision of a lower court that found their nomination was erroneous, prompting them to move to the Court of Appeal in September 2023.Their nominations were withdrawn by Chief Magistrate Dennis Mikoyan in March 2023, citing UDA’s reliance on a list deemed void by the Political Parties Tribunal.

Judge Reuben Nyakundi gave the MCAs an immediate order to resign, upholding the decision of the two earlier courts.”The names of the nine affected persons as Members of the Uasin Gishu County Assembly under the special category and the gender top-up list are deleted,” the judge decided.

Furthermore, Tabitha Wambui, Gerald Kiplagat, Regina Chumba, and Robert Kiptanui will also be nominated as MCAs under the special category. The UDA party did not say if it planned to appeal the decision to the Supreme Court.
