Filed Petition Seeking Removal Of Justice Esther Maina
Deputy President Rigathi Gachagua has said that he will appeal to have Justice Esther Maina removed from office on Thursday.
Speaking on Sunday in Elgeyo Marakwet, Gachagua declared that he would pursue Justice Maina’s removal per Chief Justice Martha Koome’s advice.
Gachagua said that Justice Maina had abruptly declared his wealth to be the proceeds of crime, a move he claims was done to damage his reputation.
“On Thursday, this coming week at 2:15 pm, I will personally present a petition before Lady Chief Justice Martha Koome against Justice Esther Maina for her removal from the Judiciary for misconduct and corruption,” Gachagua stated.
The DP further stated that Justice Maina turned down his request to cross-examine the case investigator and denied him the chance to be heard in opposition to all evidentiary rules.
Additionally, Gachagua challenged CJ Koome to disclose the quantity of petitions brought against judges, claiming it is high time she told Kenyans the truth.
Gachagua’s request to have his accounts unfrozen by the Assets Recovery Agency was denied by Justice Maina in 2022.
The Ksh202 million in his accounts, however, were ruled to be the proceeds of corruption by the court, and Gachagua was granted his money back when he and President William Ruto came to power after the general election in 2022.
The reason for his planned petition against Justice Maina is the ongoing animosity between the executive and the judiciary. President Ruto has been criticizing the judiciary for ruling against his projects, claiming that it is rife with corruption, and he has vowed to take all necessary measures to deal with corrupt judiciary officials.
