In an attempt to force the Land Registrar to provide her a title deed for 1,000 hectares of land located in Taita Taveta County, former First Lady Mama Ngina Kenyatta has filed a lawsuit.
Mama Ngina and former Taveta MP Basil Criticos argue that they are co-owners of the land in court documents filed at the Milimani High Court that were accessed by the source.
The two added that even though they are the rightful owners of the land, they have not yet received the title deed and have named Attorney General Justin Muturi as a respondent.
The two further stated that the only person who can provide an explanation for their denial of the title deed is the Land Registrar.
“The First Respondent has up until now neglected to provide the MP and the former First Lady with the aforementioned Certificate of Title pertaining to the aforementioned land lot L.R. No. 10287/7 Taveta, in violation of his stated statutory obligation or duty.
“The said breach or failure by the 1st respondent (the Chief Land Registrar) denies the applicants the statutory right to have or hold the said Certificate of Title as evidence of proprietorship of their said parcel of land,” according to a portion of the court papers.
The two wanted the issue to be deemed urgent. As a result, the case was deemed urgent by Justice John Chigiti, and it was stipulated that Mama Ngina and the former MP would have to submit a substantive motion within 14 days.
Additionally, Muturi and the Land Registrar were instructed to file and serve their answers no later than 14 days following the applicants’ service.
After then, the applicants have 14 days to file and serve their submissions. After that, the Respondents have 14 days from the date of service to submit and serve their submissions.
