Strict Rules For Agencies Sending Kenyans Abroad

New regulations to control recruiters who take Kenyans overseas have been  mooted by Senator Crystal Asige, a nominee. Asige seeks to require all agencies and recruiters to obtain a license before to  being permitted to function, and they intend to accomplish this through the  National Employment Authority (Amendment) Bill 2023.

Recruiters must apply for a license with the appropriate government in accordance with the law, providing information about their operations, business location, and the nations to which they are sending employees.They will also have to supply an indemnity policy for the workers.

Additionally, all recruiters will have to pay the levy as stipulated by law.The levy will be applied to an overseas worker’s emergency repatriation. If the worker dies while abroad, the money will also be used to transport their body back to the United States.

Additionally, each recruiter will have to publish and submit a report to the National job Authority (NEA) detailing the individuals hired, their job status, any openings, and any other data the NEA requests.However, the Kenya Gazette will have to publish the list of authorized recruiters, as mandated by NEA.

A register of all recruiters who have been given a full or conditional license will likewise be kept and maintained by the agency.”The authority shall, in as far as possible, facilitate the deployment of Kenyan workers only to countries where the rights of Kenyan migrant workers are protected,” according to a portion of the legislation.

According to the Senator, remittances from Kenyans employed abroad—estimated at more than Ksh4 billion annually—make a significant contribution to Kenya’s economy.”It is paramount that the laws of the country protect the welfare of these Kenyans and not only ensure their continued contribution to the economy,” she said.
