Charges Against Busia MCA for Defiling a 14-Year-Old Minor
Carlbenz Okonya, a Bunyala MCA, was charged with defiling a 14-year-old juvenile and arraigned on Tuesday, September 26.The MCA was brought before Busia Chief Magistrate Edna Nyaloti and entered a not guilty plea. She will be held in detention till the case is resolved.
The Office of the Director of Public Prosecutions (ODPP) announced in a statement that “a member of the Busia County Assembly was today arraigned before the Busia Chief Magistrate, Hon. Edna Nyaloti for defiling a 14-year-old.”The prosecution filed a motion to oppose bail and bond during the proceedings, and asked that the hearing be postponed for 14 days.
The witness protection agency will have two weeks to evaluate the victim and her family and put them under protection while the inquiry is ongoing, the prosecution claims.The Bunyala West MCA, however, entered a not guilty plea to the accusations.
The MCA will be held in jail until a decision is made regarding the prosecution’s application, which is scheduled to be made on September 28, 2023. At that time, the court will decide whether to grant the suspect bail, a bond, or none of the two.
“The Bunyala West Member of the County Assembly pleaded not guilty to the charges and will remain in custody pending a ruling on the prosecution application to be delivered on 28/9/2023,” the statement said, in part.Defilement is a crime that is punishable under the Sexual Offense Act, Number 3 of 2006, and involves engaging in conduct that causes penetration with a child.
According to the Act, anyone found guilty of defiling a kid who is eleven years old or less will receive a life sentence in jail.
