TSC Terminates 73 Teachers Due to Disciplinary Issues
Following many disciplinary hearings, the instructors Service Commission (TSC) terminated 73 instructors.
The names of the sacked teachers, along with their TSC numbers, disciplinary case numbers, and date of removal, were published in a Gazette Notice on Friday by CEO Nancy Macharia of the employees’ company.
According to her, persons on the list must stop working as teachers as of the removal date. Ten of the 73 sacked teachers were also kicked off the Board of Management (BOM) out of a total of 73.
The TSC states that unless a person is registered under the Teachers Act, they may not engage in the teaching profession.
According to the Code of Regulations for Teachers, this indicates that they are not permitted to teach or provide instructional support in any school.Part of the Act states, “A person shall not engage in the teaching service unless such person is registered as a teacher under this Act.”
If a teacher’s name is struck off the register due to this Act. It cannot be put back on without the Commission’s approval.
Schools were advised by Macharia not to hire unregistered teachers at their facilities. If they did, they would be in violation of the law . And subject to a fine of at least Ksh100,000, a two-year jail sentence, or both.
The TSC states that the Commission may terminate a teacher’s appointment with one month’s written notice . Or by paying one month’s basic salary in lieu of the notice.
The commission may terminate an appointment with permanent and pensionable terms upon three months’ written notice, or upon payment of one month’s basic salary in lieu of three months’ written notice.
In instances involving temporary appointments, benefits from the National Social Security Fund (NSSF) are administered in accordance with NSSF Act Cap 258.
A reimbursement of the contributions made by male educators who paid into the Widows and Children’s Pension Scheme (WCPS) is available.
